Madrid, Seat for International Arbitration
Institutional Advantages
Over the last few decades Madrid has experienced great developments in arbitration culture, mainly due to the international opening of the region and the Spanish Law on Arbitration of 2003.
“Commitment from Madrid’s institutions to support arbitration.”
Another change that has contributed significantly to the arbitration culture is the attitude of the tribunals towards the process, which today express a favourable attitude, promoting and facilitating arbitration.
The majority of Madrid institutions related to the world of Arbitration have demonstrated their commitment to support the project to position Madrid as a Seat for International Arbitration. This includes the related regional government ministries (Justice and Economy), The General Council of the Judiciary Power of Spain, the regional bar associations (Madrid and Alcalá de Henares), the Notary Publics and Registrars Association and the Spanish Arbitration Club.
The commitment to the project of the Ministry of Justice and Public Administrations has been proven through the decision to provide facilities exclusive to the use of commercial arbitration in the Madrid Campus of Justice. These facilities will provide a hearing room, various meeting rooms, an administration section as well as a library/study room, all of which will be equipped with the latest technology.
Lastly, it is worth mentioning that in 2005 the number of arbitrations in Spain increased by 10%, with more than a third of disputes being held in Madrid.
